Abstract
This was an application for judicial review of the Secretary of State for Health's decision to make an emergency contraceptive pill (Levonelle) available over pharmacy counters by way of a statutory instrument(Prescription Only Medicines (Human Use) Amendment (No.3) Order2000 (S.1. 2000 No. 3231), hereafter 'the 2000 Order'). The claimant was seeking two remedies: (1) an order of certiorari, thus quashing the order and (2) a declaration that the Secretary of State had acted ultra vires in passing the order on the following grounds
