Abstract

The government's Consultation Paper, 'Managing people with severe personality disorder: proposals for policy development' proposes to continue and extent preventative detention to dangerous individuals who have committed no criminal offence. The Consultation Paper outlines 2 options: Option A would retain the present legislative framework with amendments. Option B would create new criminal and civil powers for the indeterminate detention of psychopaths. A 'DSPD direction' would be attached to any sentence allowing for detention in a new specialist facility. Such an order would also be made during an offender's detention in prison resulting in the individual's transfer from prison to specialist facilities. The same result would be achieved through civil proceedings where there has been on criminal conviction. Discusses these proposals. (Quotes from original text)
